Spousal support (sometimes referred to as “alimony”) may be granted to either spouse. Spousal support initially provides support during the divorce process and may continue to provide a financial basis for a spouse for a set period of time after the divorce. In some cases, an Order for spousal support may be permanent.

Determining Spousal Support / Alimony Payments

In arriving at a decision to order alimony, the family court judge will consider a specific set of factors, such as:

  • The length of the marriage
  • The age and health of each spouse
  • Each spouse's ability to be self-supporting, taking into consideration past work experience and education
  • Each spouse's financial status and ability to pay
  • The presence of domestic violence in the relationship
